1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player," "User," "you") and smsm.ph ("smsm.ph," "the Platform," "we," "us," "our"), the operator of the online casino and sports betting platform accessible at smsmph.net.

By accessing, registering on, or using smsm.ph in any capacity — including browsing the platform, creating an account, depositing funds, placing wagers, or claiming any promotional offer — you unconditionally accept these Terms and any additional rules, policies, or guidelines published on smsm.ph, including the Privacy Policy, Responsible Gaming Policy, and individual game rules, all of which are incorporated herein by reference.

These Terms take effect immediately upon your first access to smsm.ph and remain in full force for the duration of your account's existence and any period thereafter during which smsm.ph continues to process obligations related to your account.

2. Eligibility

To be eligible to use smsm.ph, you must:

• Be legally permitted to participate in online gambling under the laws of your jurisdiction;

• Not be listed on PAGCOR's or any other regulatory authority's exclusion or prohibition register;
• Have the legal capacity to enter into a binding agreement;
• Register only one (1) account per individual — multiple accounts per person are strictly prohibited;
• Not be an employee, director, officer, agent, or contractor of smsm.ph or any affiliated entity, nor an immediate family member of such persons.

smsm.ph reserves the right to request identity verification documents at any time and to suspend or close accounts where eligibility cannot be confirmed. Any winnings accrued by an ineligible player are void and subject to forfeiture.

3. Account Registration

To access real-money games on smsm.ph, you must create a registered account. During the registration process, you agree to provide accurate, complete, and current information, including your full legal name, date of birth, residential address, Philippine mobile number, and a valid email address.

You are required to complete the smsm.ph Know Your Customer (KYC) verification process by providing a valid, government-issued Philippine identification document before your first withdrawal and as mandated by PAGCOR compliance requirements. Acceptable identification includes: Philippine National ID (PhilSys), passport, driver's licence, SSS/GSIS ID, PRC ID, Voter's ID, or Postal ID.

You are solely responsible for maintaining the confidentiality of your smsm.ph account credentials, including your username and password. You must not share your login details with any third party. smsm.ph will not be liable for any losses arising from unauthorised use of your account where you have failed to safeguard your credentials.

smsm.ph accounts are personal and non-transferable. You may not sell, transfer, or assign your account or any rights attached to it to any other person or entity.

4. Deposits & Payments

smsm.ph accepts deposits exclusively in Philippine Peso (PHP). The minimum deposit is ₱100. Accepted payment methods include GCash, PayMaya, BPI, BDO, and Metrobank. smsm.ph does not charge deposit fees; however, your payment service provider may impose their own charges for which smsm.ph bears no responsibility.

All funds deposited to smsm.ph must originate from payment accounts that are registered in your own name. Deposits from third-party accounts — including accounts registered in another person's name — are prohibited and may result in account suspension and forfeiture of associated funds pending investigation.

smsm.ph does not extend credit to players. You may only wager funds that are already present in your account balance. Deposits are final and non-refundable except in the circumstances explicitly described under these Terms or as required by applicable law.

smsm.ph employs anti-money laundering (AML) monitoring systems. Unusual deposit patterns may trigger account reviews. smsm.ph may request the source-of-funds documentation as required by PAGCOR AML obligations.

5. Withdrawals

Withdrawal requests on smsm.ph are processed subject to the following conditions:

• The minimum withdrawal amount is ₱200;
• The maximum withdrawal is ₱200,000 per calendar day;
• KYC verification must be completed before the first withdrawal is processed;
• Withdrawals are processed only to payment accounts registered in the same name as the smsm.ph account;
• GCash and PayMaya withdrawals typically process within minutes of approval;
• Bank transfers to BPI, BDO, and Metrobank are processed same business day for requests submitted before 3:00 PM Philippine Standard Time (PST);
• smsm.ph reserves the right to conduct additional verification checks before processing any withdrawal.

Any withdrawal request that involves funds suspected of originating from fraudulent activity, bonus abuse, or a breach of these Terms may be withheld pending investigation. smsm.ph reserves the right to recover any erroneously credited funds from your account balance.

6. Bonuses & Promotions

smsm.ph may offer bonuses, free credits, cashback, and other promotional incentives from time to time. All promotional offers are subject to specific terms published at the time of the offer, including wagering requirements, minimum odds, game restrictions, and expiry periods.

General conditions applicable to all smsm.ph promotions unless stated otherwise:

• One promotion per player, household, IP address, or payment method unless explicitly stated;
• Bonus funds must satisfy applicable wagering requirements before withdrawal is permitted;
• smsm.ph reserves the right to modify, suspend, or withdraw any promotional offer at any time;
• Participation in promotions in bad faith — including but not limited to bonus abuse, arbitrage betting, or collusion — will result in cancellation of the bonus and may result in account closure;
• Bonuses are not transferable between accounts.

7. Game Rules & Fair Play

All casino games on smsm.ph — including slots, live dealer tables, bingo, and card games — operate using independently audited Random Number Generator (RNG) software certified for fairness and unpredictability in accordance with PAGCOR licensing standards. Published Return to Player (RTP) percentages reflect theoretical long-term averages and do not guarantee individual session outcomes.

Live dealer games are governed by the rules published within each respective game lobby. In the event of a dispute between a player and a live dealer result, smsm.ph's decision — informed by video recording review — is final and binding.

Technical malfunctions — including but not limited to server outages, connectivity failures, or client-side errors — void all affected game rounds. Any wagers placed during a malfunction will be returned to the player's balance; winnings generated during a confirmed malfunction are void.

8. Prohibited Conduct

The following conduct is strictly prohibited on smsm.ph and may result in immediate account suspension, balance forfeiture, and referral to PAGCOR or relevant law enforcement authorities:

• Providing false, misleading, or fraudulent information during registration or KYC;
• Registering more than one (1) smsm.ph account;
• Using smsm.ph for money laundering, fraud, or any other illegal financial activity;
• Exploiting software bugs, glitches, or vulnerabilities to gain an unfair advantage;
• Using automated software, bots, artificial intelligence, or scripts to interact with smsm.ph;
• Colluding with other players or smsm.ph staff to manipulate game outcomes;
• Engaging in systematic bonus abuse, including multi-accounting for promotional purposes;
• Reverse engineering, scraping, or reproducing any part of the smsm.ph platform without written authorisation;
• Attempting to access accounts other than your own.

9. Account Suspension & Termination

smsm.ph reserves the right to suspend, restrict, or permanently close any account at its sole discretion, with or without prior notice, in circumstances including but not limited to:

• Suspected breach of these Terms;
• Failure to complete KYC verification within a reasonable period;
• Detection of fraudulent activity or AML concerns;
• Account inactivity exceeding 12 consecutive months (dormant account procedures apply);
• A court order, PAGCOR directive, or other regulatory instruction requiring account closure;
• Player-initiated self-exclusion request.

Upon account closure for reasons attributable to player misconduct or a breach of these Terms, any bonus funds in the account will be voided. Genuine real-money balances — to the extent not subject to an ongoing investigation — will be returned to the player via their verified payment method, net of any applicable processing costs.

10. Responsible Gaming

smsm.ph provides the following responsible gaming tools to all registered players, accessible from within the account settings panel:

• Deposit Limits: Set daily, weekly, or monthly caps on the amount you can deposit. Limit reductions take effect immediately; increases are subject to a mandatory 24-hour cooling-off period.
• Loss Limits: Restrict the maximum amount you can lose within a defined time period.
• Session Time Limits: Set maximum session duration with automatic logout. Pop-up reminders activate at configurable intervals.
• Self-Exclusion: Temporarily or permanently exclude yourself from all real-money games on smsm.ph. Exclusions are enforced immediately and cannot be reversed until the elected period expires. Permanent exclusions are irreversible.

11. Intellectual Property

All content on smsm.ph — including but not limited to the platform design, software, logos, graphics, text, game assets, and compiled databases — is the exclusive property of smsm.ph or its licensors and is protected under applicable Philippine and international intellectual property law.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use smsm.ph solely for your personal, non-commercial entertainment purposes in accordance with these Terms. This licence does not constitute a transfer of ownership and does not permit you to reproduce, copy, modify, distribute, create derivative works from, or commercially exploit any part of smsm.ph without prior written consent.

12. Limitation of Liability

To the fullest extent permitted by applicable Philippine law, smsm.ph shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the smsm.ph platform, including losses arising from: platform downtime, technical failures, third-party payment provider errors, or decisions made by you in reliance on information published on smsm.ph.

smsm.ph's total aggregate liability to any player in respect of any claim arising under or in connection with these Terms shall not exceed the amount of funds held in that player's verified smsm.ph account at the time the claim arises.

smsm.ph makes no warranty — express or implied — that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. You access and use smsm.ph at your own risk.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or in connection with these Terms — including disputes regarding their existence, validity, interpretation, or termination — shall be subject to the exclusive jurisdiction of the competent courts of the Republic of the Philippines and, where applicable, the regulatory authority of PAGCOR.

Players are encouraged to raise disputes in the first instance through smsm.ph's internal dispute resolution process by contacting customer support via live chat. smsm.ph will acknowledge disputes within 48 hours and aim to resolve them within ten (10) business days.

14. Amendments to These Terms

smsm.ph reserves the right to amend these Terms at any time. Material changes will be communicated to registered players via email to their registered address or via an in-platform notification prior to the effective date of the change. Continued use of smsm.ph following notification of amended Terms constitutes your acceptance of the updated Terms.
